克内斯蒂尔合并学说的关键是其适用条件.其适用条件的不确定性,成就了美国法院在政府采购救济中的独特地位与作用,同时使得该学说在具体运用的过程中引起了较大的争议,也使学说在现实中的运用受到了较大的限制.然而该学说对美国救济制度的影响是深远的,美国法院在采购救济过程中坚持政府利益至上的基本原则也是值得探讨的.
