行政滥用职权是当前行政权力运行过程中普遍存在的一种现象,在实践中的表现形式多种多样.正当程序原则是行政行为正当性之源,既能够对行政滥用职权起到事前或事中的监督作用,又能够规制行政权力的运行.为使正当程序原则能够对行政滥用职权发挥规制作用,必须将正当程序作为基本法治原则加以确立并完善相应的制度,同时应对违反正当程序原则的权力滥用行为进行问责.
