法官的裁判模式分为逻辑推理模式和价值衡量模式。逻辑推理模式要求法官严格按照三段论形式进行裁判,其中理性因素占主导地位。而价值衡量模式须考虑与案件相关的社会环境、经济状况、价值观念等,其中不可避免地带有法官的非理性因素。逻辑推理模式和价值衡量模式在司法适用中是相互结合的。法官的理性和非理性因素相辅相成,相互渗透,影响着法官的裁判行为和司法进程。要使法官的非理性因素在审判中发挥积极作用,必须加以引导和规制。

Judges＇ judgement has logical reasoning and value measurement model. Logical reasoning mode asks judge to use syllogism strictly,in which are dominated by rational factors. The value measurement mode should consider social environment,economic status,value concept in connection with the case,which will have irrational factors of judge inevitably.
