民事裁判博弈是指利用博弈理论来分析民事裁判过程。它需要假定参与者是理性的,主要讨论的是双方当事人和法官在裁判过程中如何通过选择策略以最大化自己的效用水平。民事裁判完全具备博弈分析的条件,对民事裁判进行博弈分析是完全可行的。运用博弈理论进行裁判不仅可以减少矛盾冲突,提高法律的实效性,也有利于查清事实真相,抑制当事人诉讼欺诈。民事裁判博弈具有信息不对称、动态互动性等特点。

Civil referee game is a process of analyzing civil judgment by game theory. It must assume that the participants are rational. The discussion focused on how parties and judges select strategies to maximize their own utility level. Civil judgment have the game analysis conditions and is feasible completely. That we use game theory to the referee can not only reduce conflicts and improve effectiveness of law, but also help to find truth and prevent the parties litigation fraud.
