死缓虽然是彰显中国特色的制度设计,但在控制死刑的实际执行上并无特效。相反,死缓的名不副实带来诸多的弊端,导致制度运行的结果是不得其利,反受其害。与其对死缓进行于事无补的改造,不如理性地予以舍弃,这既是法律逻辑的合理展开,也体现了对政治话语的准确理解。
